Know Your Regulators: Administrative Guidance for Businesses and their Counsel

Administrative guidance (policy statements, non-binding guidelines, etc.) from regulators and government ministries is an important part of the regulatory environment within which businesses must operate. Guidance only becomes more influential as government agencies move toward “results-based” or “principles-based” regulation. However, the question of how to work with guidance has not yet attracted the explicit attention it warrants in British Columbia. Businesses are subject to different guidance standards from one government agency to the next, and businesses operating internationally or cross-border must respond to multiple and potentially inconsistent guidance regimes. The purpose of this important event is to create a forum within which regulators, businesses, and their counsel can engage in a dialogue about administrative guidance.
